Objection !
The series has gone complex as it is. But still it doesn't matter who's Tobi. coz, Its Madara who wants to use the Tsuyomi Mangenkyo Sharingan and by that theory, even Kakashi or Sasuke can be Tobi

Well Kakashi cant really use the full potential of the Mangekyou Sharingan...the power it holds when it goes Eternal with the eyes of a sibling...thus Kakashi wouldve gone blind ages back if he was Madara...

There are many facts to point out that it is not Kakashi. First thing, he is a good guy.
Moreover it is Tobi who wants to use the Eternam Mangekyo Tskuiyomi. Madara also has not shown his real face as a proof that he is indeed Madara.
He may be Madara for all we know but we can't be sure. It can be a complete new guy as well.

We can't be sure until it is confirmed that Tobi is Madara. It may be someone else acting such. Moreover Tobi can control people without anyone realizing. Isn't that Shisui's power?

True, Tobi never actually told he his madara, but when he threatened to kill naruto, and when he first met itachi, he wore the vaugely same mask...

When 'Tobi' met Pain and Konan after Deidara's death, he revealed himself to be Madara !! , and also he told Sasuke that the Amaratesu, would only work against his sharingan..

Wait a second. I can claim to be Shigeru Miyamoto but that doesn't make me him.
This may be one of Madara's fan doing it.
Also he didn't confirm to either Itachi or Minato that he is indeed Madara. His powers are much like Danzo.
